MTD Construction ("MTD," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights available to you when you visit mtd-construction.com, request a project estimate, complete the Remodel Readiness assessment, or otherwise contact us (collectively, the "Site" and "Services"). By using the Site or submitting a form, you acknowledge this Policy.
1. Information We Collect
- Information you provide directly: full name, email address, phone number, mailing/project address, project type, budget range, photos or descriptions of your project, and anything else you type into our estimate request form, Remodel Readiness quiz, or exit-intent checklist form.
- Information collected automatically: IP address, approximate geographic location, device and browser type, referring page, pages viewed, and interactions with the Site, collected via cookies, pixels, and similar technologies.
- Information from third parties: if you reach us through a paid ad, review site, or referral partner, we may receive information about that referral (e.g., which ad or search term led you here) to measure marketing performance.
2. How We Use Your Information
- To schedule, prepare, and deliver your free design-build project estimate and related consultation.
- To contact you by phone, text message, or email about your inquiry, project status, scheduling, and — where you've consented — related offers (see Section 3 below for calls and texts specifically).
- To operate, secure, and improve the Site, including understanding which pages and ads perform well.
- To comply with legal obligations, enforce our Terms of Service, and protect the rights, safety, and property of MTD, our customers, and the public.
3. Calls, Texts & the Telephone Consumer Protection Act (TCPA)
When you submit your phone number through our estimate request form, you are asked to affirmatively check a box confirming the following, which forms your express consent under the federal Telephone Consumer Protection Act (47 U.S.C. § 227) and its implementing regulations:
- You agree that MTD Construction (and its authorized scheduling/CRM vendors acting on our behalf) may contact you at the phone number you provided using calls, SMS/text messages, and automated or prerecorded messages, including messages sent via an automatic telephone dialing system, regarding your project inquiry and related scheduling.
- Consent is not a condition of purchase. You are never required to agree to receive automated calls or texts in order to buy any goods or services from us.
- Message frequency varies. Message and data rates may apply, and are your responsibility under your mobile carrier plan.
- Opt out anytime. Reply STOP to any text message to stop receiving texts from that number, or reply HELP for help. You may also revoke consent at any time by calling us at [PHONE NUMBER] or emailing matt@mtd-construction.com. We will honor opt-out requests promptly.
- Carriers are not liable for delayed or undelivered messages.
- We maintain a record of the consent captured through our forms (timestamp, form, and IP address) for as long as required to demonstrate compliance.
Regardless of marketing consent, we may still contact you by phone, text, or email for non-marketing, transactional purposes directly related to a project you've already engaged us for (e.g., confirming a scheduled appointment), to the extent permitted by law.
4. Cookies & Analytics
We use cookies and similar technologies, along with third-party analytics and advertising tools (e.g., Google Analytics, Meta Pixel, Microsoft Clarity), to understand how visitors use the Site and to measure the performance of our advertising. You can control or delete cookies through your browser settings; disabling cookies may affect how parts of the Site function.
5. How We Share Information
We do not sell your personal information. We share it only with:
- Service providers who perform functions on our behalf, such as scheduling, CRM/lead management, SMS/email delivery, hosting, and analytics — bound by contract to use your information only to provide those services.
- Legal & safety reasons: when required by law, subpoena, or legal process, or to protect the rights, property, or safety of MTD, our customers, or others.
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections.
6. Data Retention
We retain personal information for as long as needed to respond to your inquiry, deliver services you've requested, comply with legal, tax, and licensing obligations, resolve disputes, and enforce our agreements — including retaining a record of TCPA consent for as long as reasonably necessary to demonstrate compliance.
7. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, or disclosure. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Your Privacy Rights (Colorado & Beyond)
If you are a Colorado resident, the Colorado Privacy Act (CPA) gives you the right to:
- Confirm whether we process your personal data, and access that data;
- Correct inaccuracies in your personal data;
- Delete personal data we hold about you;
- Obtain a portable copy of your data; and
- Opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
To exercise any of these rights, email matt@mtd-construction.com with "Privacy Request" in the subject line. We will verify your request and respond within the timeframe required by law. If we decline a request, you may appeal by replying to our decision; if the appeal is denied, Colorado law permits you to contact the Colorado Attorney General's office. Residents of other states with comparable privacy laws may exercise equivalent rights by using the same contact method.
9. Do Not Track & Do Not Call
Some browsers offer a "Do Not Track" signal; because no common industry standard exists yet, our Site does not currently respond to these signals. Separately, if your phone number is registered on the National Do Not Call Registry, submitting our form and providing express consent as described in Section 3 authorizes contact from MTD Construction specifically about your inquiry, notwithstanding that registration, to the extent permitted by the TCPA and Telemarketing Sales Rule.
10. Children's Privacy
The Site is intended for adults seeking home construction and remodeling services and is not directed at children under 13. We do not knowingly collect personal information from children under 13.
11. Third-Party Links
The Site may link to or embed third-party tools (e.g., scheduling widgets, review platforms, mapping services). We are not responsible for the privacy practices of those third parties; review their policies separately.

We may update this Privacy Policy from time to time. The "Last updated" date above reflects the most recent revision. Material changes will be posted on this page.
